What is the CAN-SPAM Act?
The CAN-SPAM Act (Controlling the Assault of Non-Solicited Pornography And Marketing Act) is a US law passed in 2003 that sets requirements for commercial email. CAN-SPAM requirements
1. No false or misleading header information — The From, To, Reply-To, and routing information must accurately identify who's sending the email.
2. No deceptive subject lines — Subject lines must accurately reflect the content of the message.
3. Identify the message as an advertisement — If not obvious from context, disclose that the message is an ad.
4. Include your physical mailing address — A valid postal address of your business must be in every commercial email.
5. Provide a clear unsubscribe mechanism — Must include a clear way to opt out of future email.
6. Honor opt-out requests promptly — Must process unsubscribes within 10 business days.

CAN-SPAM vs GDPR vs CASL
CAN-SPAM (US): Opt-out based — you can email people without prior consent as long as you provide an unsubscribe mechanism. Focus on deceptive practices.
GDPR (EU): Opt-in based — requires explicit prior consent before sending marketing email. Also covers data processing, storage rights, and breaches.
CASL (Canada): Stricter than CAN-SPAM — requires express or implied consent before sending. Implied consent has specific conditions and expiry.
If you send email internationally, you must comply with the laws of each recipient's jurisdiction. GDPR and CASL are stricter — if you meet those standards, you likely meet CAN-SPAM.
Best practices beyond compliance
